Nevada Attorney General Adam Laxalt has issued an opinion that the state’s new “universal background check” law is unenforceable. The Bloomberg-backed ballot initiative requires that private transfers be subject to an FBI NICS check. FFLs conduct background checks through the Nevada Central Repository, which checks state mental health records and domestic battery convictions, as well as performing an electronic NICS check. The FBI has refused because states cannot “dictate how federal resources are applied.” NRA Nevadans for Freedom’s Ryan Hamilton says Question 1 chose this approach to avoid having to reveal the cost to taxpayers. With the vote passing by less than one percent, it would have failed otherwise. The state legislature cannot change the language of the Background Checks Act for three years.
